WHO IS OUR DATA PROTECTION POLICY FOR?
This policy applies to all our contractors and visitors as well as to people who show an interest in the activities of the Fondation KANAL.
WHAT CATEGORIES OF PERSONAL DATA DO WE PROCESS?
General personal information
- Natural persons:
Family name, forename, gender, language, date of birth, address, telephone number, (landline/mobile), e-mail address
- Companies:
Company name, legal form, address, VAT number
- Contact persons:
Family name, forename, gender, Language, date of birth, address, telephone number, (landline/portable), e-mail address
Information on your interests or preferences
Your personal data recorded may also contain other information, such as your leisure activities and interests which you have told us about in the course of actions or surveys carried out by the Fondation KANAL.
Transaction information
If you have identified yourself during your purchases, for example because you have requested an invoice or made a reservation, we may record information about you from these transactions, such as your subscriptions, your participation in our activities, or your purchases in our KANAL STORE.
We may also record responses or comments about purchased products or services that we receive from you as part of satisfaction surveys or market research, or any complaints you make to us.

We may also record information about you provided by third parties
We may use information provided by external partners to contact you for prospecting purposes. When we contact you as part of a marketing campaign and you have not provided us with your personal information, you can always contact us to find out which external partner has passed us this personal information.
We may also use information from third parties to correct, supplement or update your personal data or to establish marketing profiles.
WHAT DO WE USE YOUR PERSONAL INFORMATION FOR? AND WHAT IS THE LEGAL BASIS OF PROCESSING?
With your consent (legal basis: article 6a of the privacy regulation):
- When you ask us questions via our website
- To keep you informed about our activities, products and/or services
- To send any newsletters to which you have subscribed or to manage your participation in our activities, sales campaigns or competitions.
You can withdraw your consent at any time by contacting us following the procedure set out in the paragraph headed "Exercising your rights".
In the course of performing your contract (legal basis : article 6b of the the privacy regulation):
- For the management of events or exhibitions in which you take part as a visitor, customer, exhibitor, sponsor or partner
- For safety management during events or exhibitions
- For follow-up and processing of your order, subscription or reservation
- For follow-up and processing of complaints and returns
- For the general management of customers and contracts, including accounting, the management of disputes and legal proceedings, the recovery or transfer of claims and the protection of our rights in general
Where we have a legitimate interest in relation to our activities. In this instance, we are always careful to strike a balance with respect for your privacy (legal basis: article 6f of the privacy regulation):
- In order to inform you about our products and services
- To centralise, combine and enrich your personal data with useful information from external partners
- To carry out studies, tests and analyses (including customer or market research) with a view to improving our products, internal procedures and overall service
- In order to conduct statistical or trend analyses for the purposes of financial management, marketing or reporting
- To prevent and combat any fraud or abuse
In order to meet our legal obligations (legal basis: article 6c of the privacy regulation):
We are also subject to legal obligations requiring us to retain and transmit certain personal information to the competent authorities and administrations (e.g. accounting and tax authorities).
CAN YOUR PERSONAL INFORMATION BE TRANSMITTED TO THIRD PARTIES?
Your personal information can be passed to our subcontractors providing services on our behalf, solely on the basis of our instructions.
TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN UNION?
We use the American tool Mailchimp for the newsletter you subscribe to. This means there is an international transfer. For more information about Mailchimp and respect for the European Regulation, please consult this Mailchimp link.
HOW LONG DO WE RETAIN YOUR PERSONAL INFORMATION FOR?
Your personal information will be kept for a maximum of ten years after the expiry of your contract or your last interaction with us. It is then deleted. We will continue to send you our newsletter unless you withdraw your consent to receive it.
HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
Your personal information is handled confidentially. We make every effort to take the technical and organisational measures necessary to guarantee its security.
WHAT ARE YOUR RIGHTS? HOW CAN YOU EXERCISE THEM?
Under the Data Protection Regulation, you have the following rights:
Right of access
You have the right to access your personal information. The law entitles you to ask for information about:
- 1) whether your personal information is recorded in our database
- 2) the processing objectives
- 3) the categories of personal data we process
- 4) the third parties or categories of third parties to which your personal data are passed on
- 5) how long we retain your personal information
- 6) the confirmation of your rights (see below)
- 7) the source of your personal information (if you did not provide it yourself)
- 8) if your personal information is processed automatically (automatic profiling), the logic used and the associated consequences
- 9) whether your personal information is transferred outside the European Economic Union and what security measures have been taken in this event
Right to rectification
You may have any inaccurate personal data relating to you rectified free of charge. You may also have erased or deleted any personal information relating to you which, having regard to the purpose of the processing, is incomplete or irrelevant, or the recording, communication or storage of which is prohibited, or which has been stored for longer than the authorised period.
Right to withdraw consent
If the processing of your personal data is based on your consent, you may withdraw it at any time.
Right to object
You may object to the processing of your personal data for the purposes of direct marketing at any time and without giving any reason. This means that you may ask us to stop using your personal data for direct marketing (when we send you promotional offers), or to establish marketing profiles (to send you the advertising that we think will be of most interest to you, based on your marketing profile).
You also have the right to object to the processing of your information based on your particular situation, in all those cases where we process your data on the basis of our legitimate interest (see above).
Right to data portability
You have the right to receive the personal data which you have provided to us, in a structured, commonly used and machine-readable format where:
- a) processing is based on consent, or on a contract;
- b) processing is carried out using automated procedures;
Under the same conditions, you also have the right to ask us to transfer this data to another data controller.
Right to be forgotten and right to restriction of processing
You have the right to have your personal information deleted. You also have the right to restrict the use of your personal information. In both cases, the conditions set out in the regulations must be met.

In accordance with the regulation, your request will be processed within thirty days of the time we are in possession of all the necessary information. If your request is complex, this period may be extended to two months, but you will be informed in advance if this is the case.
If you believe that your personal information has been processed in a way that does not comply with the European Regulation, you may lodge a complaint with the Data Protection Authority, free of charge, in the event of difficulties encountered in exercising these rights or failure to comply with obligations arising from the Regulation at contact@apd-gba.be.
